Well a lot of people will call on my show and say, I want to copyright this or trademark that and then see if they can sell it to someone and they don’t want to use it, they just want to sell it and they are so proud of themselves, they made up some idea or a name or something.  And you really can't squat on a name and get trademark protection for it, the court only will reward usage of that, it's all about usage, how are you using it, very few things are trademarked.  But the courts look at where you are using it, who is using it first and were they really using it to create commerce, because that's what the courts reward, activity that creates more commerce.
